The suit says Jones was waiting on the side of the road by his disabled vehicle when Raja shot him.

According to the complaint, at no time did Raja identify himself as a police officer. The suit also alleges that the city failed to properly train and supervise its officers including Raja.

The suit happened on the same day the city released 911 calls of the shooting.

"The release of today’s 911 tapes by Officer Raja and an unidentified witness, further proves that Raja’s narrative of what occurred on the early morning hours of October 18th is inconsistent with the objective evidence,"  the attorneys for the family said in a written release.

Raja was charged with attempted first-degree murder and manslaughter charges in the October 2015 shooting death of Jones and is currently on house arrest as he awaits trial.

The family seeks damages in excess of $15,000 and has requested a jury trial.

Asked to respond the city of Palm Beach Gardens issued this statement:

Due to matters of pending litigation, the City will not be commenting at this time.
