(CNN) - One Starbucks customer thinks there is too much ice in the chain's iced coffee, and he's suing to get it changed.
Stacy Pincus has filed a $5 million lawsuit against the coffee chain in Chicago, accusing it of using too much ice in its cold drinks.
The suit claims that Starbucks advertises its cold drinks by fluid ounce, but the size advertised is not the size customers receive.
For example, the lawsuit says a venti cold drink is advertised as having 24 ounces, but only 14 ounces is the drink and the rest is ice.
A spokesperson for Starbucks says the company is aware of Pincus' claim and believes it is without merit.
