Judge denies motion to push back Dalia Dippolito's retrial

A judge has denied a motion to push back the retrial for Dalia Dippoilto. Jury selection will begin as scheduled on December 1.

“This case needs to be resolved,” Judge Glenn Kelly said at a hearing Thursday morning.

Police arrested the Boynton Beach woman in 2009 for trying to hire someone to kill her then husband.  A jury convicted her in 2011, but the courts granted her a retrial after her defense team successful appealed the case. They argued that comments made in the courtroom tainted the jury pool. 

Also Thursday, one of Dippolito’s lawyers, Mark Eiglarsh, withdrew from the case. In a court filing, the Miami-Dade-based attorney cited “irreconcilable differences” as his reason for stepping down from the case.

That leaves California-based Brian Claypool and West Palm Beach-based Greg Rosenfeld on Dippolito’s defense team.

Rosenfeld asked Judge Kelley to push back the trial date saying he needs more time to prepare after Eiglarsh’s departure. Kelley countered saying Rosenfeld has been assigned to the case since January 2016 and should be prepared.

While leaving the courtroom, Rosenfeld said, “We are looking forward to Ms. Dippolito’s day in court.”
